Your Offer Accepted in Scotland: Essential Next Steps for First-Time Buyers

Securing an accepted offer is fantastic news, but it is just the beginning of your journey to owning your first home in Scotland. The process here has some unique aspects, particularly concerning 'missives' and the legal framework. Let us walk you through what happens next, ensuring you feel supported and informed every step of the way.
Engage a Solicitor Promptly
If you have not already, your very first action should be to formally instruct a solicitor. They are absolutely essential for handling the legal intricacies of your purchase. Your solicitor will manage the 'missives' process, which is the exchange of formal letters between your solicitor and the seller's solicitor that forms the legally binding contract for the sale. This is a critical stage, so choosing a solicitor you trust and who communicates clearly is paramount.
Understanding Missives: The Scottish Contract
In Scotland, the contract for buying a property is formed through a series of formal letters known as 'missives'. Unlike in England, where contracts are exchanged simultaneously, missives are exchanged incrementally. Your solicitor will review the 'initial offer' (which you will have already submitted) and then receive a 'qualified acceptance' from the seller's solicitor. This qualified acceptance will likely include conditions or amendments. Your solicitor will negotiate these points on your behalf, sending 'further missives' until all conditions are agreed upon by both parties. Once all missives are exchanged and agreed, the contract becomes 'concluded' and legally binding. This is a significant moment, as neither party can withdraw without penalty.
Arranging Your Mortgage
While your offer has been accepted, ensure your mortgage arrangements are progressing smoothly. If you have a mortgage 'Agreement in Principle', now is the time to finalise your full mortgage application. Your lender will require a valuation of the property which is detailed on the home report but occasionally your lender may instruct their own mortgage valuation. Keep your solicitor updated on your mortgage progress, as they will need to liaise with your lender regarding funds and legal charges.
Property Survey and Searches
In Scotland, sellers typically provide a Home Report, which includes a survey, an energy performance certificate, and a property questionnaire. However, depending on the age or type of property, or if you have specific concerns, you might consider commissioning an additional, more detailed survey (such as a 'scheme two' or 'scheme three' survey) for your peace of mind. Your solicitor will also conduct various legal searches, including checking the property's title deeds, local authority searches, and any planning permissions or building warrants.
Setting a Date of Entry
The 'date of entry' (or settlement date) is when you officially take ownership of the property and receive the keys. This date will be agreed upon during the missives process. Your solicitor will coordinate with your mortgage lender to ensure funds are ready for transfer on this date. On the date of entry, your solicitor will transfer the purchase price to the seller's solicitor, register your ownership with the Land Register of Scotland, and arrange for the keys to be released to you.
Insurance and Utilities
It is crucial to arrange buildings insurance for your new home from the date of entry. Your mortgage lender will insist on this. You will also need to contact utility providers (electricity, gas, internet) to set up accounts in your name for your move-in date.
